Thanks Ron - looks like I missed the important point - ie:

"For your protection, if you do not select your security level before August
31, 2002, High Security will default to "on" for all of your domain names."

I would be interested to know if this applies to all Namescout accounts.
 I registered a .com.au on behalf of a client with Namescout recently (which
was an extraordinarily painful process but thats another issue) and made
sure I selected "off" for these settings.

If the default setting in their registration process is "on" and they then
send out this email to give the registrant a second chance to turn it "off"
then that's possibly defensible.

If however the default setting is "off" and they then send this out which,
if not acted upon, changes the setting to "on" then that's clearly not acceptable.

What also bothers me about this is that it doesn't identify the domain name(s)
in question and indeed appears to be a general newsletter type communication
sent to account holders.  

Can Oznet confirm whether the domain name(s) they have registered with Namescout
are .au or TLDs?  If they're TLDs then its either an issue for ICANN or
the Fair Trading office in Barbados (good luck with either of those bodies),
but if they're sending this out to .au registrants then that's a matter
for auDA...

Perhaps someone from Namescout can explain the process and their justifications
for it?
