Discount Domain Name Services breaches new transfer policy

 

Melbourne, 18 June 2003 - auDA has found that actions by Discount Domain
Name Services (DDNS) breached the new Transfers (Change of Registrar of
Record) Policy (auDA published policy number 2003-03 located at
http://www.auda.org.au/docs/auda-2003-03.pdf) 

 

The new policy came into force on Monday 16th June 2003. Under the
policy a transfer of a domain name from one registrar of record to
another became free. However, registrars are required to obtain
authorisation from the registrant.

 

On Monday 16th June 2003 DDNS initiated over 1600 transfers from other
registrars to itself which auDA has found had not been authorised by the
relevant registrants.

 

auDA has taken the following actions:-

 

1.      Instructed AusRegistry to transfer each domain name transferred
by DDNS back to its original registrar of record.

2.      Directed the original registrars of record to send an
explanatory communication to each affected registrant.

3.      Directed DDNS to post a corrective notice on its web site, for a
period of 30 days.

4.      Prohibited DDNS (for a period of 60 days) from transferring any
domain name from another registrar to itself unless it provides auDA
with a copy of the relevant authorisation, and auDA provides its
consent. 

5.      Required DDNS to review its systems and procedures to ensure
that DDNS adheres to all of its obligations under the published policies
and the Registrar Agreement.
